Flag of EgyptAn Egyptian court has ruled that the case of former President Hosni Mubarak be retried following its decision to accept an appeal against his life sentence in relation to the death of protesters in 2011.

Judge Ahmed Ali Abdel Rahman declared that his court was accepting the appeal filed by the defendant and ordered a retrial which according to Mubarak?s judicial team of defendants would be based on the same evidence of the previous trial.

"No new evidence will be added to the case," Judge Rahman confirmed.

He also withdrew the acquittal of Mubarak, sons Gamal and Alaa and disgraced tycoon Hussein Salem on corruption charges.

Mubarak?s supporters reacted cheerily to Sunday?s ruling with "Long live justice!" slogans as they foisted the former leader?s portraits in court as others chanted "We love you, president!" outside the building in Cairo.

Mubarak, who is still under custody, will face a retrial over corruption despite being acquitted in June. A panel of judges will also consider claims of ill-health by the former Egyptian leader who is being held in a military hospital following a fall in December.

His ex-Interior Minister Habib al-Adly is also scheduled to undergo a retrial of the same charge of casing the death of protesters who had taken to the streets of Cairo and other cities in 2011 demanding the resignation of Mr. Mubarak who had ruled Egypt for 30 years.

The 84 year old was forced from power by the popular uprising which ushered in a new dispensation last year with the election of Muslim Brotherhood politician Mohammed Morsi in June.

Meanwhile on Saturday, Mubarak was subjected to intense questioning by investigators probing into the gifts worth millions of Egyptian pounds he had allegedly received from the state newspaper, Al-Ahram.
