HBT: Cuban out of running to buy Dodgers

UPDATE: Well, we can cross two big names off the list. Bill Shaikin of the Los Angeles Times has learned that the groups led by Mark Cuban and former agent Dennis Gilbert didn?t make it to the second round of the bidding process.

Meanwhile, Tony Jackson of ESPNLosAngeles.com hears that Peter O?Malley?s group and the group led by?Stanley Gold (who runs the investment firm for the family of the late Roy Disney) have advanced. O?Malley has reportedly discussed joining forces with Gold?s group.

9:30 PM: We learned earlier this week that the Dodgers received more than 10 opening bids in advance of Monday?s deadline from those interested in buying the team from Frank McCourt. The opening bids aren?t binding and new bidders could still emerge in the days to come, but we have some early word on who made it through to the next round.

Bill Shaikin of the Los Angeles Times reports that?at least eight groups have advanced, including the Magic Johnson/Stan Kasten group, the Joe Torre/Rick Caruso?group and the group headed by hedge fund manager?Steven Cohen. No word on any others, but it?s safe to say most of the big names are sticking around.

The Dodgers released a statement a little while ago confirming that ?the round of preliminary bidding has been completed successfully.? However, they didn?t say who advanced or provide a timeline for the next step.

The embattled McCourt faces an April 30 deadline to sell the team and has agreed to identify the winning bidder by April 1. The sale is expected to fetch an MLB record price tag in excess of $1 billion.

Longtime Oprah associate exits OWN (Reuters)

LOS ANGELES, Jan 26 (TheWrap.com) ? Another day, another shakeup for Oprah Winfrey's struggling network OWN.

Lisa Erspamer, the network's executive vice president of production and development, left on Wednesday. An OWN spokesperson told TheWrap in a statement that Erspamer is leaving "by mutual agreement to pursue other opportunities."

Erspamer was no casual employee of Winfrey's. She came aboard the network in January 2010 as a 15-year veteran of Winfrey's Harpo Productions, Inc., and had been the co-executive producer of "The Oprah Winfrey Show" since 2006. During her tenure at "The Oprah Winfrey Show," Erspamer oversaw key events such as Winfrey's two-part interview with Whitney Houston, and the now-infamous car giveaway.

Rita Mullin, senior vice president of content strategy for Discovery Fit & Health, will step into Erspamer's position in the interim. In addition to Discovery, Mullin has also served as vice president of development at TLC, where she developed such hits as "Jon & Kate Plus 8" and "18 Kids and Counting."

Erspamer's exit is the latest in a string of departures, voluntary and otherwise, for the fledgling network. Last May, CEO Christina Norman was replaced by Discovery Communications COO Peter Liguori. (Winfrey herself assumed the title of "permanent CEO" of the network in July.) More recently, longtime Winfrey pal Gayle King left to take a seat at CBS' morning offering "Early Show," while OWN's programming boss Rod Aissa jumped ship to Oxygen Media earlier this month.

Despite the tumult, there have been signs of life for OWN lately. Its new offering "Oprah's Next Chapter" premiered on January 1 to the network's biggest numbers since its January 2011 launch, with the second installment of the interview series growing 45 percent over the premiere, with 1.6 million total viewers.

Deadline first reported the news of Erspamer's departure.

Group: Chinese police clash with Tibetans, 1 dead (AP)

BEIJING ? Chinese security forces fired at Tibetans, killing one and wounding several others, an activist group said Friday, in the third reported deadly clash in a politically sensitive Tibetan region in a week.

The Tibetans were trying to stop security forces in southwest China from detaining a youth who posted a leaflet saying that self-immolations wouldn't stop until Tibet is free, the International Campaign for Tibet said.

At least 16 Buddhist monks, nuns and other Tibetans have set themselves on fire in protest in the past year, mostly in traditionally Tibetan areas of southwestern Sichuan province. Most have chanted for Tibetan freedom and the return of their spiritual leader, the Dalai Lama, who fled to India amid an abortive uprising against Chinese rule in 1959.

The London-based group said a youth named Tarpa posted a leaflet in Sichuan's Aba prefecture "stating that the reason for the self-immolation protests was that Tibet must be free and the Dalai Lama must return, and until these demands were met, there was no way for the campaign to be stopped."

He wrote his own name on the leaflet and posted a photo of himself, saying that Chinese authorities could come and arrest him if they wished, group spokeswoman Kate Saunders said in an email.

Security forces arrested Tarpa about two hours later, Saunders said.

"As they were taking him away, people nearby tried their best to block the way, shouting slogans, and warning the police that if they arrested Tarpa they would provoke a mass protest. The police responded by firing into the crowd. According to our sources, one person was killed on the spot and several wounded."

Saunders said the Tibetan shot was a 20-year-old friend of Tarpa's, a student named Urgen. She said the area was under lockdown Friday.

The incident, as with most reported clashes in Tibetan areas, could not be independently verified because of a heavy security presence and lack of access for outsiders.

On Monday, several thousand Tibetans in Ganzi prefecture in Sichuan province marched to government offices and police opened fire into the crowd, killing up to three people, witnesses and activist groups said.

A day later, security forces opened fire on a crowd of protesters in another area of Ganzi, killing two Tibetans and wounding several more, according to the group Free Tibet. The Chinese government said a "mob" of people charged a police station and injured 14 officers, forcing police to open fire on them. The official Xinhua News Agency said police killed one rioter and injured another.

China says Tibet has been under its rule for centuries, but many Tibetans say the region was functionally independent for most of that time.

Obama to talk price of college at Michigan

By Alan Silverleib and Tom Cohen, CNN

updated 2:04 AM EST, Fri January 27, 2012

President Obama spoke at a UPS freight facility in Las Vegas, Nevada Thursday.

STORY HIGHLIGHTS

  • Obama will speak at the University of Michigan on Friday morning
  • He gave a commencement speech there in 2010
  • The president is on a three-day swing through five politically important states
  • On Thursday, Obama spoke in Las Vegas about increased federal investment in clean energy

(CNN) -- President Barack Obama will talk about keeping college affordable during the final leg of his road trip focusing on themes announced in the State of the Union address.

Obama's speech at the University of Michigan will be his second there since he took office as he gave the commencement speech in 2010.

On Thursday, Obama spoke in Las Vegas about increased federal investment in clean energy and told a crowd in Colorado that America must compete in a global growth industry.

The federal government on Thursday announced plans to sell off oil and gas leases on 38 million acres of the Gulf of Mexico seafloor in a new domestic energy push.

The leases could yield as much as 1 billion barrels of oil and 4 trillion cubic feet of natural gas, the Interior Department estimates. The sale scheduled in June will be the second since the Deepwater Horizon disaster of 2010 when nearly 5 million barrels of crude spewed into the Gulf.

Obama mentioned the planned lease sales in his remarks at Buckley Air Force Base in Aurora, Colorado, which has a 1-megawatt solar array and last year test-piloted jets that run on advanced biofuels.

"We are the Saudi Arabia of natural gas," he told the military crowd in detailing his strategy to increase domestic oil and gas development while promoting investment and innovation in clean energy development.

His energy proposals come amid criticism from Republicans and the oil industry for the administration's rejection of a permit to build a pipeline to transport oil from Canada's tar sands production in northern Alberta to the Gulf of Mexico.

Obama has said the permit was rejected because Republicans forced a decision before there was time for a necessary review of a proposed route change requested by Nebraska officials, including the state's Republican governor. The president also said the rejection was due to timing, rather than the merits of the project that would create several thousand jobs for the two-year construction period.

In his remarks earlier Thursday at a UPS facility in Las Vegas, Obama called his energy plan an "all-out, all-in, all-of-the-above strategy that develops every available source of American energy."

Among other things, Obama promised more federal assistance for local governments to upgrade their automotive fleets while also pushing new tax incentives for cleaner corporate vehicles.

The president also said the administration is working to develop up to five highway natural gas corridors, and he announced a new competition to encourage the development of breakthroughs for natural gas vehicles.

"We've got to keep at it. Think about what could happen if we do," Obama said. "Think about an America where more cars and trucks are running on domestic natural gas than on foreign oil. Think about an America where our companies are leading the world in developing natural gas technology and creating a generation of new energy jobs. ... We can do this."

The president's remarks Friday will come on the last day of a three-day road trip building on themes announced in Tuesday night's State of the Union address.

CNN's Matt Smith contributed to this report.

'28 Days Later' star Murphy makes Sundance return (omg!)

Actor Cillian Murphy, left, actress Sigourney Weaver, center, and writer Rodrigo Cortes, from the film "Red Lights," pose for a portrait during the 2012 Sundance Film Festival on Saturday, Jan. 21, 2012, in Park City, Utah. (AP Photo/Victoria Will)

PARK CITY, Utah (AP) ? Nine years later, Cillian Murphy is back at the Sundance Film Festival, where he got such great exposure that people finally learned to pronounce his name.

The Irish actor ? whose first name begins with a hard K sound ? was a breakout star at Sundance in 2003 with the horror hit "28 Days Later." He has returned to this year's festival with the thriller "Red Lights."

The film about a London man who wakes from a coma to find the land overrun by a plague that has turned people into raging zombies already was a hit in Great Britain when it played at the festival.

The rousing reception at Sundance built U.S. buzz for the film and for Murphy, who went on to appear in Christopher Nolan's "Batman Begins," ''The Dark Knight" and "Inception."

"When it was well-received here, that had a big impact on its release in the States," said Murphy, who had a handful of credits behind him when director Danny Boyle ("Trainspotting," ''Slumdog Millionaire") cast him in the lead of "28 Days Later."

"I think that was my first time in a film with a real, proper director, a name director. And it was a nice part, so I guess people attempted to pronounce my name after that. That was definitely the watershed."

Along with roles in Nolan's blockbusters, Murphy went on to star in Boyle's science-fiction tale "Sunshine," Neil Jordan's transgender story "Breakfast on Pluto," Wes Craven's airline thriller "Red Eye" and Ken Loach's Irish historical drama "The Wind that Shakes the Barley," which earned the top prize at the 2006 Cannes Film Festival.

In writer-director Rodrigo Cortes' "Red Lights," Murphy and Sigourney Weaver play researchers who debunk phony claims of the paranormal, while Robert De Niro co-stars as a superstar psychic.

Millennium Entertainment announced Wednesday that it has picked up the U.S. theatrical rights for "Red Lights."

Gingrich reveals income, but not how he earned it (AP)

WASHINGTON ? Yes, Newt Gingrich beat Mitt Romney to the punch by releasing his most recent tax returns. But Gingrich still hasn't disclosed how he earned most of his $3.1 million.

Gingrich's 2010 return shows that $2.4 million of his income came in regular payments, in addition to his salary, from different businesses he ran before announcing his candidacy for president.

Those businesses managed speaking engagements, appearance fees, consulting work, book and video deals, and paid positions that Gingrich held in other groups.

Gingrich doesn't identify where the money came from or the amounts he received from his consulting business.

His campaign hasn't decided whether it will release further information about Gingrich's income.

Other GOP presidential candidates, including Romney and Rick Santorum, have provided details of such income.

Bruce Jenner: My teens don't need college

By Us Weekly

Who needs a college degree when fame and fortune awaits?

Since their first appearance on "Keeping Up With the Kardashians" in 2007, Kendall and Kylie Jenner have become stars in their own right, thanks to lucrative modeling campaigns and a thriving teen fashion empire.

PHOTOS: Kardashians as kids

When Us Weekly spoke to their father Bruce Jenner at the Performance 3D demonstration in NYC Monday, the 62-year-old Olympian admitted his girls' careers are so busy they may not pursue higher education.

"If they want to go to college, certainly, I think it's a good idea. But I'm not the advocate of, 'You've got to go to college!'" Bruce said. "I think by the time they graduate from high school, they will probably be in a position to go right to working."

EXCLUSIVE VIDEO: Bruce defends Kendall's racy bikini photo shoot

Like their older sisters Kourtney, 32, Kim, 31, and Khloe, 27, Kendall and Kylie are becoming branded businesswomen, Bruce explained. "They've just developing their clothing line for Sears -- it's a little more teen-oriented, the clothing line. And they're working all the time on the show."

With two magazine covers under her belt (American Cheerleader and Teen Prom), Kendall, 16, is poised to become the next big supermodel, Bruce added.

VIDEO: Bruce freaks out when he finds out Kendall is on birth control

"She'll probably have a career by the time she's out of high school," Bruce told Us. "If that's what she wants to do, that's good. I don't know if college is going to be that important for her."

Do you agree the girls don't need college? Vote in our poll, and tell us on Facebook.

Bruce Jenner's teens have millions. Do they need college?

Tim and Eric drop a 'Billion' at Sundance

(AP) ? Tim Heidecker and Eric Wareheim are guilty of a bit of exaggeration with the title of their Sundance Film Festival premiere.

In "Tim and Eric's Billion Dollar Movie," the writer-directors play filmmakers who squander the biggest movie budget ever on helicopter rides to work, a personal guru and other extravagances.

In truth, their own expenses were in line with the low budgets on which Sundance filmmakers typically get by.

"Imagine what goes into the cost of one of these gifting suites at Sundance. It's probably close to the budget we had," Heidecker said, referring to the merchandise hotspots that pop up at the festival for stars to stop by and collect free swag.

"Billion Dollar Movie" marks the directing debut for Heidecker and Wareheim, the comedy team behind TV's "Tim and Eric Awesome Show, Great Job!" The movie is playing in Sundance's midnight section, a collection of over-the-top horror, action, comedy and other extreme films for night-owl crowds.

They also co-star in "The Comedy," director Rick Alverson's tale of aging, directionless Brooklyn hipsters that is among the 16 films in Sundance's U.S. dramatic competition.

Debuting on video-on-demand Friday and in theaters March 2, "Billion Dollar Movie" centers on efforts by Wareheim and Heidecker's characters to renovate a derelict shopping mall to earn back the $1 billion they owe for their cinematic misadventure.

The movie features such pals of the filmmakers as Will Ferrell, John C. Reilly and Will Forte, who all have appeared on Heidecker and Wareheim's TV show.

Both 35, Heidecker and Wareheim met in film school at Temple University in the mid-1990s. They found they shared a warped sense of humor and have been partnered up ever since.

"Billion Dollar Movie" blends the gross with the grosser, featuring gags about crude sex, penis piercings, scabby skin conditions and other crudities. It also includes subtler, off-kilter jokes.

"We like mixing some of those potty jokes with things that have some awkwardness," Wareheim said in an interview alongside Heidecker. "One of my favorite parts in the movie is when Tim takes a man's son and claims him as his own. So that kind of father-son awkwardness is something we really love."

"We try to mix the lowbrow with the highbrow and the no-brow. All over the place," Heidecker said. "Weird stuff and stuff that's manipulating the editing and sounds. Really kind of create a general seasickness feeling for the audience."

Co-star Forte said there's a late-night indigestion quality to Heidecker and Wareheim's comedy.

"I described it at some point as your dreams when you've eaten right before you went to sleep. Everything's a little crazier, a little more insane," Forte said. "It's hard to explain. They're definitely people, and they're saying words, but it's bonkers, the way they put everything together."

Kuwait: Envoy to US during Iraq invasion dies (AP)

KUWAIT CITY ? Sheik Saud Al Nasser Al Sabah, who served as Kuwait's ambassador to the U.S. during Iraq's 1990 invasion of the oil-rich country and the American-led war to oust Saddam Hussein's forces, has died, a government-backed newspaper reported Sunday. He was 68.

Al-Qabas said the former diplomat died Saturday. It gave no cause of death.

A member of Kuwait's royal family, Sheik Nasser was a leading voice calling for international help during Iraq's occupation. But he was forced to defend his tactics when it was revealed that his then-teenage daughter, Nayirah, told U.S. lawmakers in October 1990 that she had witnessed Iraqi soldiers yank newborn babies from incubators. Several rights groups later questioned the account, which helped galvanize U.S. public opinion in favor of war.

A statement Sunday from former President George H. W. Bush called Sheik Nasser a "trusted partner" during the occupation and the U.S.-led war in 1991 that drove Saddam's military from Kuwait.

"Throughout that defining ordeal, he stood proudly with the United States as our coalition ejected Saddam's forces from Kuwaiti soil and upheld international law," said Bush's statement from Houston. "He was truly a good man, and a joy with whom to work."

Sheik Nasser served as Kuwait's envoy to Washington from 1981 to 1992. He later served in Kuwait's government as information minister and oil minister.

In the past decade, he played an elder statesmen's role with close ties to the White House and U.S. officials.

He also was a strong opponent of anti-Western views by Islamic hard-liners in Kuwait. In 2003, he joined other Kuwaiti leaders in endorsing the U.S. invasion of Iraq and called it the "beginning of the end" for Muslim extremists.

Al-Qabas newspaper said a funeral was scheduled for Sunday.

Ben Watson: 'The LA Complex' Reveals Gay Black Character

Betcha didn't see that coming, huh? Episode two of the hot new MuchMusic (and soon-to-be The CW) show the "The L.A. Complex" ended with aspiring hip-hop artist Tariq (Benjamin Charles Watson) locking lips with his tough-as-nails hip-hop mentor/boss, King (Andra Fuller). It's the first time a TV show has explored the taboo topic of being gay in the hip-hop world, and it's already provoked quite the reaction from fans.

The Huffington Post caught up with Watson to find out what it's been like as a young actor tackling such a controversial character, chatting about everything from filming the nerve-wracking scene with Fuller to how he feels about his new life as an accidental role model.

You had a pretty major scene at the end of last week's episode! What kind of reaction have you been getting so far?

The second it ended I was getting tweets and Facebook messages with people saying, "Omigod! What just happened? I never saw that coming!" It was completely out of left field for a lot of people. It was the perfect response I was hoping to get. Everyone's dying to know what's going to happen in episode three.

What was it like filming that scene?

It was nerve-wracking because Andra and I knew it was coming, and it was one of the last scenes of the day. Plus there are so many people around us! We had two choices -- we could run away and hide or jump right in and fulfill the needs of these characters. So we jumped right in!

Offhand, I can't even think of an openly gay man in the rap or hip-hop worlds, so in that sense your characters are pretty groundbreaking...

It's controversial and it's amazing at the same time. There have already been a lot of comments on the 'net, and a lot of people are already turned off by it because it's not done in the hip-hop world by two black guys. It's just not done. I feel a lot of pressure -- good pressure and bad pressure. It's a story that has to be told and has to be told right. I can't think about the negative part, I just have to fulfill the story of Tariq.

How did your family react?

I'm black Jamaican, so it was a little controversial! There were a lot of people who were like "Awesome!" but there were some people who were turned off by it. They reacted a lot better than I thought they would have, let's put it that way. It shocked a lot of people, but what can I do?

Can you give some hints about what will happen in future episodes? Will this affair stay a secret?

I can guarantee you there are a ton of people on the down-low in the hip-hop world. We're not the type of show that's going to be like, 'Cool, we're going to tell the hip-hop world that it's time to come out!' and all of that stuff. It's going to be true to life, so it has to be a relationship on the DL. We can't just come out and be like, "cool, we're in the hip-hop world, we're proud, we're gay." As much as we'd like to do that, it's just not realistic. So yeah, it's going to be a relationship on the DL. And... things happen! A lot of things happen. These next four episodes are ridiculously amazing, so a lot of people are going to be stunned by what happens.

I'm dying of curiosity because HuffPost interviewed [co-creator] Martin Gero a couple of weeks ago, and he said that all of the characters are based on real people. Do you know who Tariq is based on? You don't have to name names, I'm just wondering if you know!

I don't know! I would love to say, "yeah, I know exactly who Tariq is," but I don't know! I have no idea. I would love to get into Martin's head!

Do you feel a sense of responsibility that comes along with this? Are you prepared to be a role model of sorts?

A lot of people have asked me that. I knew that in taking on a role like this, it was going to come with the territory. This is one of the last characters that they cast in the series. I knew that it would be a very tough role to cast, especially being a black guy whose character is gay on the show and in hip-hop -- it's a lot for someone to take on. A lot of people aren't going to be comfortable portraying this role on television. I want to help people. Hopefully I will get an opportunity to help through something like the It Gets Better campaign or PSAs. I would absolutely love the opportunity to do something like that.

Do you think the American reaction is going to be different when this starts airing on The CW?

Oh, man, wow. I'm freaking out because I don't know. With every good reaction there's going to be a counter bad reaction, so I'm just going to have to go with the flow! I'm freaking out thinking about it right now. Thanks for bringing it up! [Laughs]

At this point, do you think the positive reaction is outweighing the negative?

On my Twitter, nothing has been negative yet. Some of the negative reactions have been coming from a lot of older black Canadians. In our culture, it's totally fine to be gay and open and all of that fun stuff, but if you're from an older generation it's still "wrong." I've been reading some negative comments, but I can't let that stop me. I just have to embrace it.

Are you worried about being typecast as a gay character for the rest of your career?

Honestly, I don't care. It was a thought that if the show was a success I might be pigeonholed, but who cares, really? I'm an actor -- that's what I do. I take on roles and then I lose the role and become me again.

"The L.A. Complex" airs Tuesdays at 9 p.m. ET on MuchMusic.

You can watch the controversial scene below -- SPOILER ALERT for those who haven't seen it!

Richard Gere On 'Arbitrage': 'All Adrenaline, Cocaine Rush'

You might think ?Arbitrage? is a staid affair, one more film about financial shenanigans in a long line of them ? each one about men with expensive suits and bankrupt morals, about buying low and selling high, about the money, money, money.

Well, it is about all those things. But as Richard Gere put it to [...]

LG Connect 4G sips some lemonade over at the FCC

What's that coming over the hill? Is it a monster? No, clearly. It's LG's Connect 4G, the company's second LTE-equipped phone which sashayed past the FCC's subterranean bunker on the way to a debut on MetroPCS' network. The CDMA/LTE unit's got the usual assortment of Bluetooth and WiFi b/g/n gizmotronics, plus an inductive cover you can use to confuse elderly relatives. Now that it's been declared fit for purpose by the boys in blue, it's well on course to meet the February launch date we'd heard about back at CES -- at a price that's "still to be determined," the spoilsports.

Top Justice officials linked to mortgage banks

U.S. Attorney General Eric Holder and Lanny Breuer, head of the Justice Department's criminal division, were partners for years at a Washington law firm that represented a Who's Who of big banks and other companies at the center of alleged foreclosure fraud, a Reuters inquiry shows.

The firm, Covington & Burling, is one of Washington's biggest white shoe law firms. Law professors and other federal ethics experts said that federal conflict of interest rules required Holder and Breuer to recuse themselves from any Justice Department decisions relating to law firm clients they personally had done work for.

Both the Justice Department and Covington declined to say if either official had personally worked on matters for the big mortgage industry clients. Justice Department spokeswoman Tracy Schmaler said Holder and Breuer had complied fully with conflict of interest regulations, but she declined to say if they had recused themselves from any matters related to the former clients.

Reuters reported in December that under Holder and Breuer, the Justice Department hasn't brought any criminal cases against big banks or other companies involved in mortgage servicing, even though copious evidence has surfaced of apparent criminal violations in foreclosure cases.

The evidence, including records from federal and state courts and local clerks' offices around the country, shows widespread forgery, perjury, obstruction of justice, and illegal foreclosures on the homes of thousands of active-duty military personnel.

In recent weeks the Justice Department has come under renewed pressure from members of Congress, state and local officials and homeowners' lawyers to open a wide-ranging criminal investigation of mortgage servicers, the biggest of which have been Covington clients. So far Justice officials haven't responded publicly to any of the requests.

While Holder and Breuer were partners at Covington, the firm's clients included the four largest U.S. banks - Bank of America, Citigroup, JP Morgan Chase and Wells Fargo & Co - as well as at least one other bank that is among the 10 largest mortgage servicers.

Defender of Freddie
Servicers perform routine mortgage maintenance tasks, including filing foreclosures, on behalf of mortgage owners, usually groups of investors who bought mortgage-backed securities.

Covington represented Freddie Mac, one of the nation's biggest issuers of mortgage backed securities, in enforcement investigations by federal financial regulators.

A particular concern by those pressing for an investigation is Covington's involvement with Virginia-based MERS Corp, which runs a vast computerized registry of mortgages. Little known before the mortgage crisis hit, MERS, which stands for Mortgage Electronic Registration Systems, has been at the center of complaints about false or erroneous mortgage documents.

Court records show that Covington, in the late 1990s, provided legal opinion letters needed to create MERS on behalf of Fannie Mae, Freddie Mac, Bank of America, JP Morgan Chase and several other large banks. It was meant to speed up registration and transfers of mortgages. By 2010, MERS claimed to own about half of all mortgages in the U.S. -- roughly 60 million loans.

But evidence in numerous state and federal court cases around the country has shown that MERS authorized thousands of bank employees to sign their names as MERS officials. The banks allegedly drew up fake mortgage assignments, making it appear falsely that they had standing to file foreclosures, and then had their own employees sign the documents as MERS "vice presidents" or "assistant secretaries."

Covington in 2004 also wrote a crucial opinion letter commissioned by MERS, providing legal justification for its electronic registry. MERS spokeswoman Karmela Lejarde declined to comment on Covington legal work done for MERS.

It isn't known to what extent if any Covington has continued to represent the banks and other mortgage firms since Holder and Breuer left. Covington declined to respond to questions from Reuters. A Covington spokeswoman said the firm had no comment.

Several lawyers for homeowners have said that even if Holder and Breuer haven't violated any ethics rules, their ties to Covington create an impression of bias toward the firms' clients, especially in the absence of any prosecutions by the Justice Department.

O. Max Gardner III, a lawyer who trains other attorneys to represent homeowners in bankruptcy court foreclosure actions, said he attributes the Justice Department's reluctance to prosecute the banks or their executives to the Obama White House's view that it might harm the economy.

But he said that the background of Holder and Breuer at Covington -- and their failure to act on foreclosure fraud or publicly recuse themselves -- "doesn't pass the smell test."

Recusal requirements
Federal ethics regulations generally require new government officials to recuse themselves for one year from involvement in matters involving clients they personally had represented at their former law firms.

President Obama imposed additional restrictions on appointees that essentially extended the ban to two years. For Holder, that ban would have expired in February 2011, and in April for Breuer. Rules also require officials to avoid creating the appearance of a conflict.

Schmaler, the Justice Department spokeswoman, said in an e-mail that "The Attorney General and Assistant Attorney General Breuer have conformed with all financial, legal and ethical obligations under law as well as additional ethical standards set by the Obama Administration."

She said they "routinely consult" the department's ethics officials for guidance. Without offering specifics, Schmaler said they "have recused themselves from matters as required by the law."

Senior government officials often move to big Washington law firms, and lawyers from those firms often move into government posts. But records show that in recent years the traffic between the Justice Department and Covington & Burling has been particularly heavy. In 2010, Holder's deputy chief of staff, John Garland, returned to Covington, as did Steven Fagell, who was Breuer's deputy chief of staff in the criminal division.

The firm has on its web site a page listing its attorneys who are former federal government officials. Covington lists 22 from the Justice Department, and 12 from U.S. Attorneys offices, the Justice Department's local federal prosecutors' offices around the country.

As Reuters reported in 2011, public records show large numbers of mortgage promissory notes with apparently forged endorsements that were submitted as evidence to courts.

There also is evidence of almost routine manufacturing of false mortgage assignments, documents that transfer ownership of mortgages between banks or to groups of investors. In foreclosure actions in courts mortgage assignments are required to show that a bank has the legal right to foreclose.

In an interview in late 2011, Raymond Brescia, a visiting professor at Yale Law School who has written about foreclosure practices said, "I think it's difficult to find a fraud of this size on the U.S. court system in U.S. history."

Holder has resisted calls for a criminal investigation since October 2010, when evidence of widespread "robo-signing" first surfaced. That involved mortgage servicer employees falsely signing and swearing to massive numbers of affidavits and other foreclosure documents that they had never read or checked for accuracy.

Recent calls for a wide-ranging criminal investigation of the mortgage servicing industry have come from members of Congress, including Senator Maria Cantwell, D-Wash., state officials, and county clerks. In recent months clerks from around the country have examined mortgage and foreclosure records filed with them and reported finding high percentages of apparently fraudulent documents.

On Wednesday, John O'Brien Jr., register of deeds in Salem, Mass., announced that he had sent 31,897 allegedly fraudulent foreclosure-related documents to Holder. O'Brien said he asked for a criminal investigation of servicers and their law firms that had filed the documents because they "show a pattern of fraud," forgery and false notarizations.

Time Warner Cable app streams live TV to iPhones, no longer iPad-only

After finally issuing a version of its TWC TV app for Android tablets and phones (sans-live TV streaming, for now) Time Warner Cable has finally made its iOS version, which launched last March on the iPad, compatible with the iPhone and iPod Touch. There's no additional charge for the app which allows for the aforementioned live TV viewing (as long as you're on your home WiFi) and DVR scheduling, and the accompanying blog post reveals the available list of channels has reached 196. We should probably mention that the app is unlikely to play nicely with any jailbroken iOS devices it encounters, so some extra hackery may be in order to get things working there. Otherwise, Time Warner customers can grab it now from iTunes at the source link below.

[Thanks, Jason]

Dennis Santiago: FDIC Resumes Bank Closings

The FDIC closed it's first banks of 2012 today. A total of three insitutions were shuttered by the regulator. Central Florida State Bank of Belleview, Florida, The First State Bank of Stockbridge, Georgia and American Eagle Savings Bank of Boothwyn, Pennsylvannia each received the dreaded visit by FDIC teams to begin their weekend absorption into a purchasing institution. All three found buyers. American Eagle was acquired by Capital Bank N.A. The First State Bank was purchased by Hamiton State Bank. Cental Florida State Bank is being integrated into CenterState Bank of Florida N.A. All banks had troubled histories prior to their closures as seen in these forensic pages released by Institutional Risk Analytics following the press releases.

AP sources: Perry abandoning bid, backing Gingrich

[unable to retrieve full-text content]CHARLESTON, S.C. (AP) ? Texas Gov. Rick Perry will abandon his presidential bid and endorse Newt Gingrich, two Republican officials said Thursday, a move coming just two days before the pivotal South Carolina primary as Republican front-runner Mitt Romney struggles to fend off a challenge from the former House speaker.

Leap second lives on, at least another week (AP)

GENEVA ? The leap second may live on for at least another three years.

Once or twice a year the leap second can be tacked on to synchronize atomic clocks ? the world's scientific timekeepers ? with Earth's rotational cycle, which does not run quite like clockwork.

Sanjay Acharya, a spokesman for the International Telecommunication Union, said Thursday a decision to abolish the leap second has been put off until next week. He said "it's been deferred" because governments were unable to reach agreement at talks this week.

Acharya said the U.S. wants to drop the leap second and Britain has argued to keep it.

Government delegates now plan to examine the issue at a separate meeting in Geneva next week, but Acharya said they will likely defer any formal decision until 2015.

Taylor Swift, Zac Efron Have Flirty Dinner Date (omg!)

Taylor Swift, Zac Efron Have Flirty Dinner Date

Is Taylor Swift ready to write a new love song about Zac Efron?

On Jan. 6, the New Year's Eve hunk, 24, had a flirty dinner with the country superstar, 22 sharing an outdoor corner table at L.A. Italian eatery Pace.

PHOTOS: Taylor's romantic past

Efron and the unlucky-in-love Swift "were deep in conversation and very giggly," a fellow diner tells the new Us Weekly of the pair, who arrived together in Efron's Audi. (Earlier in the week, the twosome supped at Pace with fellow phenom Justin Bieber.)

It's not the first time the cute duo have flirted in public. Back in 2009, Efron -- single since splitting with Vanessa Hudgens in December 2010 -- called Swift a "lovely girl, very beautiful." In turn, the Grammy-winning singer, dumped by Jake Gyllenhaal in December 2010, gushed that Efron was an "all-around amazing guy."

PHOTOS: How Zac became a hunk

Not so fast, one Swift insider says. "They were in L.A. doing press stuff together, and after they were done, they decided to grab dinner." (They're costars in the film Dr. Seuss' The Lorax.

"They have been friends a long time," an Efron source says.

Adds another insider. "Taylor thinks Zac's cute?[but] they are on totally different wavelengths."

Blocking Keystone Won't Stop Oil Sands Production

Oil storage tanks at the Chevron Burnaby Oil Refinery on the shores of Burrard Inlet, east of Vancouver, British Columbia. Andy Clark/Reuters/Landov

Oil storage tanks at the Chevron Burnaby Oil Refinery on the shores of Burrard Inlet, east of Vancouver, British Columbia.

President Obama is feeling election-year pressure over the pending decision on the Keystone XL pipeline. Republicans say the Canadian project would provide the U.S. with oil and new jobs, but environmentalists want Obama to block it. They say Alberta's oil sands generate more greenhouse gases than other kinds of oil, and Americans must not become dependent on such a dirty source of energy. But it may already be too late to change that.

Tucked in among the ranch houses in Burnaby, British Columbia, a quiet suburb east of Vancouver, is the terminal for the Trans Mountain Pipeline, which brings in oil from Alberta. For decades, that oil was mainly consumed in the Vancouver region. But that is changing.

Ben West, an anti-oil tanker activist with a group called the Wilderness Committee, says when the pipeline company Kinder Morgan bought this facility in 2005, it shifted its focus to exports ? primarily to the American West Coast.

"We've seen this huge increase of tanker traffic," he says. "We went from 22 tankers in 2005, up to 79 [in 2010]. You know these 700,000-barrel tankers that are now coming through the Burrard Inlet, which passes through one of the most populated areas of British Columbia."

The pipeline also has a branch that crosses the border, feeding crude oil to refineries in Washington state. Kinder Morgan is now exploring the possibility of doubling the pipeline's capacity. West calls it the "quiet repurposing" of the Trans Mountain Pipeline. And because of it, oil sands gasoline is now fueling cars from Seattle to San Francisco.

Philip Verleger, an economist who specializes in oil markets, says even if environmentalists convince Obama to block the Keystone XL pipeline, it won't stop the growth of production in the Canadian oil sands.

"With prices around a hundred dollars a barrel globally, that oil is going to make it to the market somehow," Verleger says. "The development may be slowed for a year or two. But one can move the oil west on the existing Kinder Morgan pipeline. They could expand pipelines east. Those pipelines already exist, and they can be expanded."

In fact, Enbridge, a Canadian energy company, recently asked Canadian regulators for permission to reverse the direction of one of its pipelines in Ontario, which many see as the first step to move more Canadian oil to the American East Coast ? and relieve some of the Canadian oil glut in the upper Midwest.

Back in Burnaby, activist West is well aware of the spider's web of pipelines exporting oil from Alberta, but that doesn't make him any less opposed to the Keystone XL.

"I think it's true that the Keystone pipeline is not the only way that the oil is making its way to market, and there's definitely enough demand that if one of these gets built, people will want to build the other ones," West says. "But, you know, we really need to turn that around."

But demand is the key, say most economists. If you can get American drivers to buy less gas ? by raising fuel efficiency standards, as the Obama administration recently did ? then, they say, you stand a much better chance of slowing production in the oil sands.

Mind the Science Gap Helping science students connect with a non-science audience

Guest post by Andrew Maynard.

Studying for a Masters degree in Public Health prepares you for many things.? But it doesn?t necessarily give you hands-on experience of how to take complex information and translate it into something others can understand and use.? Yet as an increasing array of public health issues hit the headlines, from fungicide redidues in orange juice to the safe development of new technologies, this is exactly where public health professionals need to be developing their skills.? And it?s not only in the public domain: the ability to translate complex science into actionable intelligence is more important now than ever in supporting policy makers and business leaders make decisions that are grounded in evidence rather than speculation.

These were just some of the drivers behind a new course I have just started teaching at the University of Michigan School of Public Health that is built around science blogging.? OK, so maybe I wanted to have a little fun with the students as well.? But my experiences with the blog 2020 Science have taught me that the discipline of writing a science-based blog for a broad audience is invaluable for developing highly transferrable communication skills.? And it?s not just me.? Emailing with the scientist, author and blogger Sheryl Kirshenbaum about the course, she admitted ?blogging taught me how to effectively communicate with broad audiences?.? (Sheryl also added that she?s also learned a great deal from many wonderful editors ? to which I can only add ?me too!?).

The new course throws ten Masters of Public Health students in at the deep end by challenging each of them to publish ten posts over ten weeks on the blog Mind The Science Gap ? and to respond to the comments they receive.? As this is a science blog, each post will be based around published health-related research.? The challenge for the writers will be to translate this into a science-grounded piece that is relevant and accessible to a broad audience.

The key objective here is to develop new skills through experience.? And for this, I am encouraging as many people as possible to comment on the posts.? As any science blogger will tell you, even simple comments like ?I liked this? or ?this was confusing? are extremely helpful in understanding what works and what doesn?t.? But I am also hoping readers will look beyond the educational aspects of the exercise, and engage with the students on the subjects they are writing about.? This is where I suspect the experience will become most empowering.

There?s another aspect of the course that intrigues me.? Rather naively, I started this exercise imagining a series of impersonal posts that focused on intellectually interesting but emotionally ambivalent scientific studies.? What I forgot is that public health matters to people.? And so it?s going to be tough for our bloggers to separate what they write about from their passions ? and those of their readers.? In fact I?m not even sure that such a separation would be appropriate ? for communication to be relevant, it needs to go beyond the numbers.? But how do you effectively combine science with a desire to make the world a better place in a blog?? I try to achieve this on my own blog, but I must admit I don?t have any easy answers here.? So as the Mind The Science Gap students develop their skills, I?m going to be doing some learning of my own as I watch how they respond to this particular challenge.

At the end of the day, Mind The Science Gap is about teaching the next generation of public health professionals how to connect more effectively with non-specialist and non-technical audiences ? whether they are managers, clients, policy makers or members of the public.? It isn?t about creating a new wave of science bloggers.? But in the process, I like to think that some of the participants will get the blogging bug. Whether they do or not, I?m looking forward to ten weeks of engaging, entertaining and hopefully challenging posts from ten talented students.
